Copyright Infringement Policy

1. Purpose and Scope

Banigig (“Banigig”, “we”, “us”, or “our”) respects the intellectual property rights of creators, copyright owners, users, and all other stakeholders.

This Copyright Infringement Policy (“Policy”) describes the procedures and rules applicable to:

  • Allegations of copyright infringement
  • Requests for removal or disabling of allegedly infringing content
  • Counter-notifications submitted by users
  • Repeat infringer enforcement

This Policy applies to all content available on or through Banigig.com, including but not limited to:

  • User Generated Content (UGC)
  • Gigs and service listings
  • Portfolios
  • Text, images, videos, audio, code, designs, and other materials

This Policy is incorporated by reference into Banigig’s Terms of Service.


2. Legal Framework

Banigig complies with applicable copyright laws, including but not limited to:

  • United States Digital Millennium Copyright Act (DMCA) – 17 U.S.C. §512
  • International copyright treaties and conventions
  • Applicable local copyright laws in jurisdictions where Banigig operates

Nothing in this Policy limits any legal rights available to copyright owners or users under applicable law.


3. Copyright Ownership Responsibility

Users are solely responsible for ensuring that any content they upload, publish, distribute, sell, or otherwise make available through Banigig:

  • Does not infringe copyrights or other intellectual property rights
  • Is owned by them or properly licensed
  • Complies with applicable laws and Banigig policies

Banigig does not pre-screen all content and does not guarantee that user-submitted content is free from infringement.


4. Reporting Copyright Infringement (DMCA Notice)

If you believe that any content available on Banigig infringes your copyright, you may submit a written copyright infringement notification (“Notice”).

To be valid, the Notice must include all of the following information as required under the DMCA:

4.1 Required Information

  1. Identification of the copyrighted work
  • A detailed description of the copyrighted work you claim has been infringed
  • If multiple works are involved, a representative list
  1. Identification of the allegedly infringing material
  • Exact URL(s) or location(s) of the material on Banigig
  • Sufficient information to allow Banigig to locate the content
  1. Your contact information
  • Full legal name
  • Physical address
  • Telephone number
  • Email address
  1. Good-faith statement
  2. A statement that you have a good-faith belief that the use of the material is not authorized by:
  • The copyright owner
  • The copyright owner’s agent
  • The law
  1. Accuracy and authority statement
  2. A statement, made under penalty of perjury, that:
  • The information in the notification is accurate
  • You are the copyright owner or authorized to act on behalf of the copyright owner
  1. Signature
  • A physical or electronic signature of the copyright owner or authorized representative

4.2 Submission Method

All copyright infringement notices must be submitted to Banigig’s designated Copyright Agent:

Incomplete or improperly formatted notices may not be processed.


5. Review and Removal Process

Upon receipt of a valid Notice, Banigig may:

  • Review the complaint for completeness and validity
  • Remove or disable access to the allegedly infringing content
  • Notify the user who uploaded the content (“Affected User”)
  • Record the complaint for repeat-infringer tracking

Banigig reserves the right to remove content without prior notice where required by law or where immediate action is necessary.


6. Counter-Notification Procedure

If you believe that your content was removed or disabled as a result of:

  • Mistake
  • Misidentification
  • Lawful use (e.g., license, fair use)

you may submit a counter-notification (“Counter-Notice”).

6.1 Required Counter-Notification Information

To be valid, the Counter-Notice must include:

  1. Identification of the removed or disabled material
  • Description of the content
  • The location (URL) where it appeared before removal
  1. Good-faith statement under penalty of perjury
  2. A statement that you have a good-faith belief the material was removed or disabled due to mistake or misidentification
  3. Consent to jurisdiction
  • Consent to the jurisdiction of the federal courts in your place of residence
  • If located outside the United States, consent to the jurisdiction of courts where Banigig is located

  • Physical address
  • Telephone number
  • Email address
  1. Signature
  • Physical or electronic signature

6.2 Counter-Notification Handling

Upon receipt of a valid Counter-Notice, Banigig may:

  • Forward the Counter-Notice to the original complainant
  • Restore the removed content after the legally required waiting period
  • Decline restoration if legal action is initiated

Banigig is not obligated to restore content in all circumstances.


7. Repeat Infringer Policy

Banigig maintains a strict repeat infringer policy.

Users who:

  • Receive multiple valid copyright complaints
  • Repeatedly upload infringing content
  • Demonstrate a pattern of copyright abuse

may face enforcement actions, including:

  • Temporary account suspension
  • Permanent account termination
  • Removal of all associated content
  • Loss of earnings or balances where permitted by law

Banigig determines repeat infringement at its sole discretion, consistent with applicable law.


8. False or Abusive Claims

Submitting knowingly false or misleading copyright notices or counter-notifications may result in:

  • Legal liability under applicable laws
  • Account suspension or termination
  • Reporting to relevant authorities

Banigig reserves the right to reject abusive, fraudulent, or bad-faith claims.


9. No Legal Advice

Banigig does not provide legal advice and does not adjudicate copyright ownership disputes.

Users are encouraged to consult legal counsel if they are unsure about their rights or obligations.


10. Cooperation with Rights Holders and Authorities

Banigig cooperates with:

  • Copyright owners
  • Law enforcement agencies
  • Judicial authorities

to address copyright infringement, fraud, and misuse of the Platform.


11. Limitation of Liability

To the maximum extent permitted by law:

  • Banigig shall not be liable for user-generated copyright infringement
  • Users remain solely responsible for their uploaded content

This Policy does not create any contractual or legal obligation beyond those required by law.


12. Modifications to This Policy

Banigig reserves the right to modify this Policy at any time.

Changes will be effective upon posting on the Platform with an updated “Last Updated” date.
